DEFINITIONS

"We", "our" or "us" means e-Logbooks Limited, trading as Flights4all, Driving4all, Shooting4all-vouchers and Horseriding4all. e-Logbooks Limited is registered in England and Wales no. 4927627.

"You" means any purchaser or recipient of a gift experience from e-Logbooks Limited.

ABOUT THESE TERMS AND CONDITIONS

These Terms and Conditions comprise the entire agreement between us and you and supersede any prior agreements with respect to the subject matter herein. If you do not agree to be bound by these terms and conditions, you may not use or access our services. You must read, agree with and accept all of the terms and conditions contained in these Terms and Conditions, which include those terms and conditions expressly set out below and those incorporated by reference. We reserve the right to modify these Terms and Conditions of service at any time.

EXPERIENCE OFFERS

We are a booking agent acting on behalf of experience operators who provide the actual events. The terms and conditions of the operator apply to the event itself, and the voucher holder contract is directly and exclusively with the event operator. We shall not accept any liability for the event whatsoever.

EVENT DESCRIPTIONS

Descriptions of experiences on our website are provided by the operators themselves, and are of necessity indicative. Details, such as the particular equipment, vehicle or route followed are subject to change depending on the specific conditions on the day.

The stated total duration is an indication of the time you are likely to spend at the venue and may be more than the amount of time each participant spends on the activity.

YOUR SAFETY

The events advertised on our website may involve some personal risk, and you may be required to prove your identity and sign a disclaimer on the day. Note that some personal insurance policies may not cover certain events, and you are advised to check your policy well in advance of the event. If you are concerned about cover, then please ask the event operator at the time of booking as to the terms of their insurance cover. We recommend that all voucher holders ensure that they are adequately insured against personal accident, personal liability and, where appropriate, with cancellation insurance.

Event operators require the voucher holder to conduct themselves in an appropriate manner. The voucher holder must take note if requested to do something for your personal safety.

We are unable to guarantee the standards of safety or the satisfactory performance of event operators. Operators should observe the highest standards of safety and often are governed by statutory rules and regulations when providing their services. However, we do not undertake any technical examination of the operators' equipment, facilities or services. We are unable to accept liability in respect of unsatisfactory provision or non-performance by the operator as the contract is between the voucher holder and the operator.

Whilst we make every effort to monitor the service provided by the event operators we do not provide any warranty or guarantee as to statements, representations and/or illustrations made by the operator, the performance of the operator with regard to the activity, or the safety standard of the operator. Therefore, any liability that is incurred by the voucher holder as a result of a failure of the operator is the responsibility of the operator and not us. We will not be responsible for any personal injury, illness, death (but, not including death or personal injury caused by our negligence), loss or damage of whatever nature (including consequential loss not within the contemplation of the parties) which includes but is not limited to loss of anticipated earnings, profits, goodwill, reputation, business receipts or contracts, losses or expenses resulting from third party claims, suffered by any customer or recipient or other person in connection with or as a result of statements, representations and illustrations made by the operator or by participating in any activity.

RESTRICTIONS

Events offered for sale through us are often subject to restrictions that might cover age, height or weight, as examples. Each individual event will list any relevant conditions that need to be met by the voucher holder, and it is the responsibility of the purchaser and the voucher holder to ensure that such conditions are met.

AVAILABILITY

Each valid voucher entitles the voucher holder to the offer as specified on the voucher itself. Each voucher has a limited period of validity during which it should be used. Arranging the experience rests with the voucher holder and the operator identified on the voucher. The ability to use the voucher on a particular date is very dependent on a number of factors, including the weather and availability of equipment and instructors, and hence the voucher holder must bear this in mind when booking an event with the operator. Although we co-operate closely with all affiliated operators, for any particular booking, the final decision about proceeding with the event rests exclusively with the operator. This is for your personal safety.

VOUCHERS

Vouchers have no monetary value but offer a limited duration entitlement to an event organised through an event operator. By purchasing a voucher you are entering into a legally binding agreement.

Vouchers for each advertised event will be identified as either transferable or non-transferable on the website and on the voucher itself. Non-transferable vouchers will be printed with the name of the recipient, and only this person can redeem the voucher with the operator. Please note that operators may ask the voucher holder for proof of identity prior to commencing an event. Transferable vouchers can be used by the voucher holder at the time of redemption.

Once you have made a purchase, a unique voucher ID will be emailed to you along with confirmation of purchase. Vouchers themselves can be delivered to the recipient either electronically or by post.

There is a small additional charge for postal dispatch, which is by first class recorded delivery. We endeavour to deliver all posted vouchers within at most five working days of purchase. Upon notification we will replace vouchers lost in the post at no additional cost.

Voucher prices quoted are inclusive of VAT and include the cost of the experience and our agents fee.

DISCOUNT HOTSEAT COUPONS

Hotseat coupons offer the bearer a discount against the price of any event gift voucher advertised directly on our websites and purchased through the e-Logbooks Limited payment gateway.

Coupons are fully transferable and are valid for use from the date of supply until the expiry date printed on the face of the coupon. After the expiry date, the coupon is no longer valid for use and has no value.

Hotseat coupons can be used in part or full payment for events; however coupons have no cash equivalent either for the entire coupon or for any unused part of its value. Each coupon is printed with a unique ID, and can only be used once. Where the face value of a coupon exceeds the cost of an event, no repayment of excess value will be due.

Once you have made a purchase, a unique coupon ID will be emailed to you along with confirmation of purchase. Coupons themselves can be delivered to the recipient either electronically or by post.

CHARGES

Prices quoted on our websites are in UK POUNDS and are inclusive of VAT. We are able to take payment in other currencies through our payment gateway, however all events take place exclusively within the United Kingdom and Northern Ireland and the purchaser and recipient must have UK mailing addresses.

If your payment is made by credit card a handling fee of 2.5% per transaction is made. No charge is made for payments made by Debit Card, cheque or BACS.

The charge quoted covers the costs of the gift voucher, the experience and the operators expenses. Excluded are any postal charges and your personal costs, such as those involved in travelling to and from the venue and any costs deriving from last minute cancellation of a pre-arranged booking.

REFUNDS

If you are not 100% satisfied with your purchase then we will be happy to refund the cost of your hotseat coupon or unbooked gift voucher provided that the request for refund is received within 14 days of the original purchase date. Refunds are no longer available once a firm booking has been made with the operator. All requests for refunds must be made in writing (including by e-mail) to Customer Service.

Please note that refunds can only be made to the original purchaser and to the same card that was used in the initial purchase. An administration fee of £10.00 + VAT will be levied on all refunds. We regret that postal costs cannot be refunded.

CANCELLATIONS

Due to the nature of the events of offer, you must be prepared for possible cancellation at short notice. It is the responsibility of the voucher holder to ensure that the arranged booking has not been cancelled prior to setting of for the venue. Unfortunately we are not able to pay any refund or compensation resulting from cancellation of an event for any reason.

If you do suffer a cancellation as notified by your operator, you must contact the operator at your earliest convenience to reschedule your event. If cancellation is caused through your own non-attendance without prior notification, then please note that you may forfeit your gift voucher, at the operator's discretion.

RENEWALS

We may be able to renew gift vouchers either during or after the valid period. Please contact us directly on 0800 043 08 08 for further information and any associated costs.

Discount hotseat coupons are non-renewable.

EXCHANGES

Under exceptional circumstances we are able to exchange vouchers for alternative experiences. Requests must be made within 14 days of purchase and an administration fee of £10.00 + VAT will be levied on all exchanges.
